General Provisions

AIlingo is a brand owned and operated by Studio Gambit Sp. z o.o. (Matejki 6, 80-232 Gdańsk, Poland, NIP (EU VAT) PL9570812544), hereinafter referred to as the Operator. The AIlingo brand is a separate program for post-editing machine translations and related technical services provided by the Operator.

These Terms of Service apply to all translation service orders carried out under the AIlingo program, hereinafter referred to as AIlingo. AIlingo services are intended exclusively for legal entities and organizations, hereinafter referred to as Clients. The Operator does not provide AIlingo services to individuals not conducting registered business activities.

Conclusion and Termination of the Agreement

The basis for concluding a translation service agreement is the commercial offer submitted by the Operator via email.

The cost estimate for written translation can be obtained automatically through the AIlingo website. The price provided this way is binding for both parties if used in the automated Pro Forma Order generation process available on the website. After positively verifying the Client’s identity, an AIlingo representative will send the Client a final commercial offer via email containing the agreed price and the proposed delivery time for the translation.

The minimum order value is EUR 22.

The agreement between the Operator and the Client is concluded when the Client confirms acceptance of the offer. By doing so, the Client agrees to the provisions of these Terms of Service.

To ensure appropriate working conditions and the safety of its employees, the Operator is entitled to withdraw from the agreement by informing the Client in writing via email no later than within 24 hours of the conclusion of the agreement if it is determined that the content of the materials provided is insufficient for proper service delivery in line with the automated estimate or contains content deemed by the Operator to be hateful, vulgar, or promoting violence. In case of the Operator’s withdrawal, neither party is entitled to claim reimbursement of costs.

If the Client withdraws from the agreement, they are obliged to pay for the work completed up to that point at 100% of its value, and for any halted work at a flat rate of PLN 90.

Complaint Procedure, Warranties, and Contractual Penalties

Any complaints regarding the improper performance of the translation service must be submitted in writing to the Operator within 10 business days from the date of service delivery. Failure to report defects within this period means that the Client irrevocably accepts the service result without reservations.

The Operator will promptly and free of charge correct all errors identified in writing, provided they are clearly identifiable.

Translations deemed unsatisfactory for stylistic reasons without indicating specific errors, understood as violations of grammatical, semantic, or orthographic rules of the target language, are not considered defective. This particularly applies to advertising and promotional materials. The Operator is also not obliged to edit the translated text in a style different from the source text.

For delays in delivery, when the delivery date is specified in the offer, the Operator will grant the Client a discount of 5% of the net order value for each full day (24 hours) of delay, but not exceeding a total of 30% of the order value. A delay of more than 6 days entitles the Client to cancel the order without incurring any costs.

Liability for Damages

The Operator does not provide any implied warranties regarding the commercial value or suitability of translated texts for a specific purpose concerning the offered AIlingo services. The Operator is not liable for any special, indirect, or consequential damages arising from lost profits, whether resulting from contract performance, negligence, or other harmful actions related to or connected with AIlingo services.

In all other cases, the Operator’s total liability for damages is limited to the invoice amount.

Confidentiality

Except for publicly available and widely known materials (press and internet publications, generally available legal acts, etc.), all documents and supporting materials entrusted by the Client are treated as confidential and are not shared in any way with third parties. The Operator declares that all employees and subcontractors involved in servicing the Client’s orders within the AIlingo services have signed confidentiality agreements regarding any information obtained from Clients. This also applies to information and data shared even if no agreement was reached between the parties. We protect your data according to the requirements of ISO 27001:2017. Submitted files are stored exclusively on our physical servers in Gdańsk, Poland.
